Terms of Service
Every good jam has a few ground rules. These Terms set them for Pickin’ Folk and for the musicians and hosts who use it to organize real-world jams.
1. Accepting these Terms
These Terms of Service are the terms for your access to Pickin’ Folk websites, mobile applications, jam discovery, jam invitations, messaging, and related services. When you set up your account, you are asked to accept these Terms, our Community Guidelines, and our Privacy Policy. By using Pickin’ Folk, you agree to them. If you do not agree, do not use the service.
Pickin’ Folk is a product of Wyvern Byte LLC. In these Terms, “we,” “us,” and “our” mean Wyvern Byte LLC, and wherever these Terms refer to Pickin’ Folk as a party (for example, granting or receiving rights, disclaiming warranties, or limiting liability), that means Wyvern Byte LLC.
2. Eligibility and accounts
You must provide accurate information, keep your credentials secure, and promptly tell us about unauthorized account use. You are responsible for activity under your account. You must be at least 18 years old to create an account. We ask for your date of birth to confirm this, and you must enter it accurately. If it shows you are under 18, the account is deleted. An account found to belong to someone under 18 will be closed. Anyone under 18 may attend a jam only as a guest of their parent or guardian, who must RSVP for them, stay with them throughout the jam, and is responsible for them.
3. What Pickin’ Folk provides
Pickin’ Folk provides tools to help people discover, organize, and communicate about informal jam sessions and musician connections. Unless explicitly stated, Pickin’ Folk does not own, operate, supervise, referee, or control a jam, venue, host, musician, or jam session and does not guarantee that a listed jam will happen as described.
4. Meeting safely and assumption of risk
Pickin’ Folk introduces musicians who may then choose to meet in person. Meeting people you do not know involves real-world risks, including risks of personal injury, property damage or theft, and harmful conduct by others. Pickin’ Folk does not conduct criminal background checks, verify identities, screen musicians or hosts, or inspect venues, and we are not present at jams. We cannot guarantee anyone’s identity, intentions, conduct, or safety.
You are solely responsible for your own safety and for your interactions with other users, online and in person. You decide whether to attend a jam, whom to meet, and where. You voluntarily assume the risks of meeting other users, and you are responsible for following applicable laws and venue rules. These precautions do not make you responsible for another person’s misconduct.
We strongly encourage you to hold first meetups with anyone new in a public place: a familiar, well-lit, populated venue during open hours. Avoid private homes and isolated, unfamiliar, or hard-to-leave locations until you know the people involved. Bring a trusted friend or tell someone where you are going and when you expect to return, arrange your own transportation, keep your phone available, and keep personal details such as your home address private until trust has been earned.
Trust your instincts. If a musician, host, venue, or situation makes you uncomfortable, leave as soon as you safely can. Once you are safe, block and report the musician or host through Pickin’ Folk so we can review the concern. Call local emergency services when immediate help is needed; Pickin’ Folk reporting is not an emergency service.
Hosts must describe the jam honestly, including the venue (and whether it is a private residence), accessibility, expected duration, costs, house rules, age expectations, and any material changes. A host designation is not a background check, safety certification, or endorsement by Pickin’ Folk.
5. The social contract
Play the person, not the loophole. You may not harass, threaten, discriminate against, impersonate, defraud, coerce, stalk, or endanger another person; ignore stated boundaries; publish unlawful or invasive content; manipulate attendance or ratings; spam musicians; access accounts or data without permission; interfere with the service; or use Pickin’ Folk for illegal activity. Our Community Guidelines are part of these Terms.
Child sexual abuse and exploitation (CSAE), including child sexual abuse material (CSAM), grooming, and sexual solicitation of minors, are strictly prohibited. Our Community Guidelines describe reporting and enforcement. There is no tolerance for objectionable content or abusive users. Content or conduct that is hateful, sexually explicit, threatening, harassing, or otherwise objectionable may be removed, and the accounts responsible may be suspended or terminated, without prior notice. You can block any user and report content or users from their profile, a jam, or a conversation.
6. Your content
You retain ownership of content you submit. You grant Pickin’ Folk a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and share that content only as needed to operate, secure, improve, and promote the service according to your settings. You represent that you have the rights needed to submit it.
8. Paid plans: Jam Pro
Jam Pro is an optional subscription that adds recurring jams for musicians who host regularly. Hosting your own jams and everything musicians need to meet and play stay free.
Jam Pro is billed monthly or yearly at the price shown before you subscribe, plus applicable taxes, and renews automatically at the end of each period until you cancel. If you subscribe in the iOS app, payment is charged to your Apple Account and you manage or cancel it in your App Store subscriptions; in the Android app, through Google Play; on the web, from Manage subscription in the app. Cancel at least 24 hours before a period ends to avoid the next charge. You keep the plan until the end of the period you paid for. If Jam Pro comes with a free trial, the first charge is made when the trial ends unless you cancel before then; trials are for new subscribers only, as each store decides. Refunds for App Store and Google Play purchases are handled by Apple and Google under their policies; except where required by law, web fees are non-refundable.
When Jam Pro ends, jams already posted stay up, but new recurring dates stop until you subscribe again. We may change Jam Pro’s features over time and will tell you before removing one you pay for. If we offer other paid plans in the future, we will show their terms before you subscribe.
9. Moderation and termination
We review reports promptly, generally within 24 hours. We may investigate reports and remove content, limit features, remove someone from a jam, cancel access to a jam, suspend, or terminate accounts when reasonably necessary to address a safety risk, legal requirement, fraud, abuse, prolonged inactivity, or a violation of these Terms. We may consider messages, session details, prior reports, and other relevant context, but we do not promise a particular outcome. You may stop using Pickin’ Folk at any time and request account closure through support.
10. Disclaimers and liability
To the fullest extent permitted by law, Pickin’ Folk is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant a musician’s or host’s identity or conduct, the condition or safety of a venue, the accuracy of a listing, uninterrupted operation, compatibility at the jam, or any jam outcome.
To the fullest extent permitted by law, Pickin’ Folk and its owners, affiliates, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the service or an in-person jam, and are not responsible for the conduct, online or offline, of any user. Any dispute you have with another user is between you and that user. Rights that cannot legally be waived remain unaffected.
You agree to indemnify and hold harmless Pickin’ Folk and its owners, affiliates, employees, and agents from claims arising out of your use of the service, your content, your violation of these Terms, or your interactions with other users, to the extent permitted by law.
11. Changes and contact
We may update these Terms prospectively by posting a revision and effective date and giving additional notice where required. When we make material changes, we will ask you to review and accept the updated Terms before you continue using the service.
